Research to examine ethical behaviour in insolvency practice

Legal academics will undertake research relating to ethics in insolvency proceedings which could impact on best practice in the future.

Dr Lézelle Jacobs from the University of Wolverhampton Law School has been awarded £10,000 from INSOL International to carry out research: Corporate Insolvency Practitioners, Ethics and Remuneration: A case of Moral Bankruptcy?

The research project will investigate provisions relating to remuneration and disbursements in insolvency proceedings to establish whether it encourages or deters ethical behaviour and high standards of moral conduct from corporate insolvency practitioners.

The outcome of this project could support the future development of best practice guidelines that could be considered when drafting remuneration and disbursement provisions.

Dr Jacobs said: “I am very pleased that this research has received funding. We hope it will inform corporate insolvency practitioners and provide assistance in the drafting of guidance documents relating to the subject field.”

Dr Jacobs joined the Law School last year having previously taught at the University of the Free State in South Africa. She has expertise in Company Law and Insolvency Law with a specialisation in Corporate Insolvency and specifically the standard of conduct to be expected of Insolvency Practitioners.

She has also been approached by the INSOL Working Group 10 to consult on the drafting of best practice rules for administrators and creditors to be used as guidance for regulatory bodies (of Insolvency Practitioners) across the world.

The research team will consist of Dr Jacobs and Professor Peter Walton, who is also currently involved in a project with the Kenyan Government to overhaul insolvency legislation in the country.

The research project on the Remuneration of Insolvency Practitioners will culminate with a research paper to be published by INSOL International and a paper to be delivered by the research team at an INSOL Conference in Singapore in April 2019.
